ATTENTION FORMER TENANTS OF
OLEN RESIDENTIAL FLORIDA APARTMENTS

The purpose of this site is to advise you of the existence of this class action settlement and how it may affect your rights.

On May 21, 2009, an Order preliminarily approving the Settlement Agreement was signed by Judge Edward Fine of the Circuit Court for Palm Beach County. A hearing will be held on August 5, 2009 to determine whether the Court will approve the Settlement as fair, reasonable, adequate and in the best interests of the Class. The Class is defined as:

Tenants and their roommates who moved or left their Olen Properties ("Olen") Florida apartment from March 2, 2002 to October 31, 2007, who signed an Olen form lease and who received a demand for fees resulting from approximately 3 months rent, "liquidated damages".

Plaintiff alleges that Olen Residential's practice of charging these amounts, whether paid by the tenant or not, was a violation of: Florida common law; the Florida Residential Landlord Tenant Act, the Florida Consumer Collection Practices Act and the Florida Deceptive and Unfair Trade Practices Act as to all members of the Class, and that such Class members are entitled to a monetary recovery and injunctive relief from Olen Residential, including attorneys' fees and costs.

Olen Residential denies any wrongdoing.
